NEWS: Common good success for Scott Blair
Posted On: 26 April 2011
Scott Blair acted for the City of Edinburgh Council in a recent successful application to the Court of Session arising from the proposal of the Council to enter into a long lease with Inch Park Community Sports Club of a large part of Inch Park. The land in question forms part of the common good of the City of Edinburgh and the consent of the Court was needed to authorise such a long lease.
Inch Park has been used as a public park and playing fields since the 1950s and there have been ongoing discussions between the Council and the Club as to the refurbishment of facilities and overall improvement of the park over the past few years. This culminated in the decision of the Council to seek to enter into an 80 year lease with the Club under which the Club will take on responsibility for the provision of upgraded and modern facilities at the site but which also ensure that public access to the park is secured for the future. The Inch Park Sports Complex which will be constructed on the site and the continued investment of money from the Council, Club and Sports Scotland will represent a major advance in the provision of sports and leisure facilities for the residents of the south east of Edinburgh.
Scott was pleased to advise the Council from the early stages of this matter and to bring it to a successful conclusion in early April when Lady Clark of Carlton granted authority to the Council to take the project forward.
Scott has also acted in other common good matters in the last couple of years for both local authorities and members of the public and has published a paper on common good law which can be accessed by clicking here.
