NEWS: James Murphie speaks at RFPG Employment Law Conference 2011

James Murphie, Advocate, was one of the guest speakers at the Royal Faculty of Procurators’ Employment Law Conference 2011 in Glasgow. This half-day conference which took place in Royal Faculty Hall on Wednesday 25 May focussed on a variety of topics within the overall subject of Employment Law. All the talks were very informative and thought-provoking.
James’ presentation entitled ‘Rewriting the Contract of Employment’ considered what limitations there are at common law on the employer’s exercise of the power of unilateral variation and assessed their effectiveness. He made specific reference to the 2010 cases of Bateman v Asda Stores Ltd and Malone v British Airways in which the courts upheld the legality of a clause in the contracts of employment which permitted the employers to vary the contract terms unilaterally.
